서울고등법원이 의대 증원을 멈춰달라는 집행정지 가처분 신청에 대해 '각하·기각' 결정을 내렸습니다. 앞서 의료계는 결과에 따라 대법원에 재항고하겠다고 예고한 바 있습니다.

■ 민주 국회의장 후보에 우원식…추미애 꺾어

더불어민주당 우원식 의원이 추미애 당선인을 꺾고 22대 전반기 국회의장 후보에 선출됐습니다. 우 의원은 민심에 어긋나는 지체나 퇴보가 생긴다면, 국회법에 따라 처리하겠다고 했습니다.

■ 김호중, 음주측정 회피 정황…계속되는 의혹들

뺑소니 혐의로 입건된 트로트 가수 김호중 씨가 사고를 낸 후 경찰의 음주 측정을 피하려 자택으로 귀가하지 않은 정황이 드러났습니다. 김씨 측은 음주 운전 의혹을 부인하고 있는데, 경찰은 조직적 은폐 시도 가능성을 조사하고 있습니다.

[속보] 서울고법, 의대증원 집행정지 각하·기각 결정

법원이 의대 증원 집행정지 항고심에서 각하와 기각 결정을 내렸습니다.

서울고법 행정7부는 의대생과 교수, 전공의 등이 의대 정원 2천명 증원·배분 결정의 효력을 멈춰달라며 정부를 상대로 낸 집행정지 신청의 항고심에 대해 각하와 기각결정을 내렸다고 밝혔습니다.

의대 증원을 막아 달라는 의료계의 주장이 1심에 이어 2심에서도 받아들여지지 않은 것입니다.

구체적으로는 재판부는 의대교수·전공의·수험생의 신청은 1심과 같이 이들이 제3자에 불과하다며 신청을 각하했습니다.

각하란 소송 요건을 갖추지 못하거나 청구 내용이 판단 대상이 아닐 경우 본안을 심리하지 않고 재판을 끝내는 결정입니다.

다만 의대 재학생들의 경우 '법률상 보호되는 이익'이 있다며 원고 적격은 있다고 판단했지만, "집행정지를 인용할 경우 공공복리에 중대한 영향을 미칠 우려가 있다"며 기각했습니다.

법원의 이번 결정에 따라 정부의 '27년 만의 의대 증원'은 조만간 최종 확정에 들어갈 전망입니다.

법원 결정을 기다렸던 일부 대학들은 의대 증원을 반영한 학칙 개정을 진행하고, 한국대학교육협의회 승인을 거쳐 각 대학들은 이달 말 혹은 다음 달 초 '수시모집요강' 발표와 함께 정원을 확정할 것으로 보입니다.

앞서 의료계는 항고심에서 자신들의 주장이 받아들여지지 않을 경우 대법원에 즉시 재항고할 뜻을 전하기도 했는데요.

재항고 절차가 있는 만큼 이달 말 혹은 다음 달 초로 예정된 대학별 정원 확정 때까지 대법원이 결정을 내리기엔 물리적으로 시간이 부족하다는게 법조계의 관측입니다.
