각종 비위 의혹으로 탄핵 소추된 이정섭 검사의 파면 여부를 가릴 탄핵 심판이 시작됐습니다.

첫 재판에서 이 검사 측은 국회 소추 내용에 기본적인 사실관계조차 불분명하다고 반박했고, 국회 측은 탄핵 필요성이 충분하다며 공방을 벌였습니다.

이채연 기자입니다.

지난해 국정감사에서 각종 비위 의혹이 불거진 뒤 현직 검사로는 헌정사상 두 번째로 탄핵 소추된 이정섭 검사.

탄핵안 가결 다섯 달여 만에 열린 헌법재판소 첫 변론에 직접 출석했습니다.

"헌법재판관님들께서 현명한 결정을 내리는 데 도움이 될 수 있도록 저희 측 입장을 충실히 설명드리겠습니다. (제기된 의혹들 부인하시는 입장이었는데 같은 입장인가) 그건 현재 검찰에서 철저하게 수사 중인 상황이고…."

첫 재판에서 이 검사 측은 먼저 검사가 탄핵 대상이 되느냐부터 따져봐야 한다고 날을 세웠습니다.

현행법상 검사 신분을 탄핵으로 박탈할 수 없다는 겁니다.

특히 국회 측이 제출한 6가지 탄핵 소추 사유에는 일시, 장소, 행위 등 구체적인 사실관계조차 담겨있지 않거나, 사실이 아니라며 탄핵 심판 청구를 기각해달라고 주장했습니다.

이에 대해 국회 측은 헌법 등에 따라 검사도 탄핵 대상에 포함될 수 있다고 일축했고, 이 검사의 행위가 파면할 정도로 법 위반의 중대성이 매우 크다고 주장했습니다.

양측은 비위 의혹을 폭로했던 이 검사 처남댁의 증인 신청 채택 여부를 두고도 공방을 벌이기도 했습니다.

재판부는 처남댁에 대한 증인 채택 여부를 결정하지 않았는데, 법원이 국회 측의 의견을 받아들인다면 이 검사와 법정 대면할 가능성이 있습니다.

헌법재판소는 오는 28일 변론을 이어갈 계획입니다.

재판부가 신속한 진행을 언급한 만큼 정해진 180일 안에 결론이 날지 주목됩니다.

더불어민주당 이재명 대표의 최측근인 김용 전 민주연구원 부원장이 보석으로 다시 풀려났습니다.

1심에서 법정구속된 지 약 160일 만에 구치소를 나섰는데요.

법원은 거주지 변경 불가와 위치 추적용 전자장치 부착 등을 보석 조건으로 명령했습니다.

진기훈 기자입니다.

김용 전 민주연구원 부원장은 더불어민주당 이재명 대표의 대선 경선 자금 불법 수수 의혹으로 지난해 11월, 1심에서 징역 5년을 선고받고 법정구속 됐습니다.

이후 김 전 부원장은 지난 2월 항소심 법원에 보석 신청을 했고, 법원은 심문 끝에 이를 받아들였습니다.

김 전 부원장이 법정 구속된 지 160일 만이며, 다음 달 2일 구속 만료를 25일 앞둔 시점입니다.

"세상의 진실이 어디 도망가겠습니까. 저는 반드시 그 진실은 나올 것이라고 보겠습니다."

법원은 주거를 서울 서초구 아파트로 제한하고 허가 없는 거주지 변경과 출국 금지, 실시간 위치 추적용 전자장치 부착을 명령했습니다.

또 법원이 지정하는 일시와 장소에 출석하고 증거를 인멸하지 않겠다는 서약서 등도 보석 조건으로 달았습니다.

앞서 검찰은 지난 3월 보석 심문에서 김 전 부원장의 보석에 강한 우려를 나타냈습니다.

1심 재판에서 사건 관계인에게 위증을 교사한 혐의 등을 받는 이재명 대표 대선캠프 출신 인물들이 구속됐다며, 이는 김 전 부원장의 증거인멸 우려가 현실화한 것이라고 주장했습니다.

특히 김 전 부원장이 석방되면 다른 사건 관계자들과 접촉해 증거를 인멸할 수 있다고 강조했습니다.

1심 재판부는 불법 정치자금 6억원과 뇌물 7천만원을 유죄로 인정했는데, 김 전 부원장과 검찰 모두 항소해 2심 재판이 진행 중입니다.

김 전 부원장은 항소심에서도 정치자금법 위반과 뇌물 혐의 모두 부인하고 있습니다.

여기에 김 전 부원장이 대장동 민간업자로부터 대선 경선 자금을 수수한 시점과 관련해 이재명 대표 대선 캠프 인사들과 조직적으로 알리바이를 조작하고 위증을 교사했다는 위증교사 의혹도 항소심의 핵심입니다.

지난해 5월 1심 재판 도중에도 보석 석방됐다 재구금된 김 전 부원장은 항소심 결과에 따라 다시 수감될 수 있습니다.
